1. General

We protect your data. Please read the following explanations carefully to find out why we collect your data and in what form we will process it.

2. What are personal data?

Personal data is information that relates to persons whose identity is identified or identifiable (e.g. name, contact details, billing data, IP address).

3. How are your personal data processed by us?

Depending on whether you visit our website, whether you are our client, whether you are our supplier or business partner, or whether you apply to us, we process your data in different ways:

3.1 Data processing of visitors to our website

We process your personal data

  • to safeguard our legitimate interests (Art 6 Paragraph 1 lit f GDPR), namely ensuring the operation, security and optimization of our website.

To improve our information offer, the following data is collected, stored and evaluated on our website when you visit our website: browser type, operating system, country, date, time and duration of access, IP address and pages visited, including entry and exit pages. The web server is located in Austria. The data is not used to personally identify the visitor to this website.

"Cookies" are used to recognize and store temporary visitor data. We only use session cookies for page analysis, ie all information is automatically deleted after a certain period of time after leaving the website. We do not use advertising cookies.

In order to achieve the purposes listed above, it may be necessary in some cases for us to disclose your data to the following recipients. This disclosure can be by transmission, dissemination, or some other form of provision.

3.2 Data processing by clients:

We process your personal data either

  • to carry out pre-contractual measures or to fulfill our contractual obligations (Art 6 Paragraph 1 lit b GDPR) within the scope of the client relationship,

  • based on your express consent (Art 6 Para 1 lit a GDPR), if you give us your consent to be named as a reference, and

  • to fulfill our legal and professional obligations (Art 6 Para 1 lit c GDPR).

The processing of your data primarily serves to carry out and process our legal services. If you do not want to provide us with your data, we cannot enter into a mandate relationship with you. You can revoke your consent to being named as a reference at any time.

We will use your contact details to send you information about our range of services and invitations to events in our office by post or email (Art 6 Paragraph 1 lit f GDPR). You have the right to object to this processing of your data for the purpose of direct mail at any time without giving reasons by letter to us or by e-mail to office@ebmer-recht.at. We will process your data for this purpose as long as you do not object , but only up to three years after termination of the contract. The processing of your personal data for the purpose of direct advertising is not necessary for the execution of our contractual relationship.

For other forms of direct mail, we will only process your data if you have given your express consent to the processing of your data (Art 6 (1) (a) GDPR). If you have consented to the data processing, you can revoke this consent without giving reasons by letter to us or by e-mail to office@ebmer-recht.at. The revocation does not affect the legality of the previous processing.

3.3 Data processing by suppliers and business partners

We process your personal data either

  • to carry out pre-contractual measures or to fulfill our contractual obligations (Art 6 Paragraph 1 lit b GDPR);

  • to fulfill our legal obligations (Art 6 Paragraph 1 lit c GDPR).

The main purpose of processing your data is to initiate, maintain and process our contracts for goods and services.

If you do not provide us with your data, we cannot enter into a business relationship with you.

3.4 Data processing of applicants:

We process your personal data either

  • to carry out pre-contractual measures (conclusion of a service contract, Art 6 Paragraph 1 lit b GDPR),

  • based on your express consent (Art 6 Para 1 lit a GDPR), if we would like to keep you as an applicant on record,

  • to fulfill our legal obligations (registration as an employee with social insurance, Art 6 Paragraph 1 lit c GDPR).

The processing of your data is used to process the application process and to register with social security if we are hiring you. If you do not provide us with your data, we will not be able to process your application.

3.5 Data processing of (potential) opponents, involved parties and informants in matters of our clients that we deal with

We also process personal data about you if you are opponents of our clients or involved parties as well as informants in matters that we take care of for our clients. We usually receive this data from our clients or their business partners, from the Internet or other available public sources as well as from other third parties who serve us as informants. Separate, specific information about the data processing will not be provided even if we come into direct contact with you in your capacity as an opponent, involved party or information person, because we are exempt from the information obligation in accordance with Art 14 (5) GDPR.

3.6 Collection of personal data from sources other than the data subject himself

In individual cases it can happen that we obtain data from other sources. These other sources are exclusively publicly available information that we obtain from the Internet or, in individual cases, from credit agencies. The data that we obtain about you from third parties and store in our systems is limited to contact information (e-mail address and telephone number, postal address), your role in the company, your professional career and your assignment to or your responsibility for a specific company (usually your employer or a company affiliated with or for other reasons with this company), if you have not disclosed this data to us in the course of communication. If you are an applicant, we can also process information from publicly available sources about your professional, school and university career as well as about works you have written. Usually, however, we will ask you directly whether you can provide us with this information if it cannot be found in your application documents. This processing is based on our legitimate interest in a complete data record about your person required for professional communication and the handling of the mandate, the business relationship and also the application process, depending on the relationship we have with you (Art 6 Paragraph 1 lit f GDPR) .

4. How long will your data be saved?

We will only store your data for as long as is necessary for the purposes for which we collected your data:

  • For tax reasons, we generally save contracts and other documents as well as related correspondence from our contractual relationship for a period of ten years.

  • According to the Lawyers' Act, we are legally obliged to keep files from mandates for five years after the end of the mandate; In individual cases, for example to assert and defend against legal claims, we keep these files for up to 30 years after the end of the mandate.

  • Data from applicants who are not hired will be deleted seven months after completion of the application process if we do not ask for their consent to keep records. Our internal data protection information for employees, which can be requested in the application process, applies to recruited applicants.

5. What rights do you have with regard to data processing?

We would also like to inform you that you have the right at any time to request information about which of your data is processed by us (see in detail Art 15 GDPR), the right to have your data corrected or deleted (see in Detail Art 16 GDPR), have the right to restrict the processing of your data (see in detail Art 18 GDPR), have the right to object to data processing (see in detail Art 21 GDPR), can assert the right to data portability (see Art in detail Art 20 GDPR).

If we process your data on the basis of your consent, you have the right to revoke this consent at any time by email to office@ebmer-recht.at or by post to lawyer Mag. Christian Ebmer MBA, Spittelwiese 6, 4020 Linz. This does not affect the legality of the data processing that has taken place up to this point in time (Art 7 (3) GDPR).

You also have the right to lodge a complaint with the Austrian data protection authority or with another data protection supervisory authority in the EU, in particular at your place of residence or work.
